Welcome to Deemly’s peer to peer trust profile service – let's call us “Deemly” for short – at the addresses www.deemly.co, trust.deemly.co and portal.deemly.co (which we shall call our “Sites”), or at the applicable plug-in of Deemly on different Marketplaces which are business partners of Deemly.

1. Your Consent

By accessing and/or using the services (or any part thereof), you agree to the terms and conditions set forth in this privacy policy, including to the collection and processing of your personal information (as defined below). If you disagree to any term provided herein, please do not access, register to or use the services in any manner whatsoever.

Please note: you are not obligated by law to provide us with any Personal Information. You hereby acknowledge and agree that you are providing us with Personal Information at your own free will, for the purposes described in Section ‎4 below, and that we may retain such Personal Information in accordance with this Privacy Policy and any applicable laws and regulations.

2. Which information we may collect on our Users

We may collect two types of data and information from our Users:

  1. Un-identified and non-identifiable information
  2. Individually identifiable information

The first type of information is un-identified and non-identifiable information pertaining to a User(s), which may be made available or gathered via the User's use of the Services.

We are not aware of the identity of the User from which the Non-personal Information was collected. Non-personal Information which is being collected consists of technical information and aggregated usage information, and may contain, among other things, the activity of the User on the Services and the navigation on these.

We use the following services:

  • Google Analytics
  • Google NLP service

Ratings and reviews collected from your profiles can often not be linked to you as they rarely contain your full name or other details.

Un-identified and non-identifiable information

The second type of information is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual, or may be of private or sensitive nature (“Personal Information”).

In the event that a User registers to the Services through his/her existing social network accounts, then the applicable social network may provide us with certain information about such User, as is stored in and/or made available by the User through his/her social network account.

Any Personal Information provided voluntarily by the User via the Services, such as the User’s images, country of residence and/or other Personal Information provided by the User, including by actions performed by the User in connection with the Services

Ratings & reviews

Data from partners

We will in most instances gather ratings and reviews from partner platforms you connect to your Deemly account.

The average rating for each platform will be shown on your Trust profile and written reviews will be displayed on your Deemly profile page.

Written reviews also provide the Word Cloud of the most common words from your reviews to be shown on your Deemly profile page.

If possible we gather this data:

  • All numeric ratings (stars, thumb up's etc.)
  • All written reviews
  • Date of review

These data are all stored with us and updated daily.

Government ID verification

You can choose to upload an image of your government ID and we will use it to verify your identity.

All uploaded files are encrypted and stored safely with our cloud host. They are not accessible through your profile.

Only approved Deemly employees have access to the files and approval tools.

Partners do not have direct access to files or information in them. The Deemly Trust Profile only provides the notions on whether or not the user has been approved.

We strive to make as much of your data with us available to you through your Deemly account. If you wish to have a complete data dump of all data points gathered about you we will make efforts to provide this within 5 working days.

The right to access to in our eyes closely related to the right of portability. We support the notion of your information being your information. Upon request we will deliver a full data dump of your Deemly account within 5 working days.

We do analysis on an aggregated level where all data is anonymised. We look into users' ratings & reviews, comparing star ratings to NLP analysis of written reviews across platforms and industries.

Partner access

By using the services in connection with any third party services, you thereby permit the company to access, process and store certain personal information made available by you and such use through such third party services.

For avoidance of doubt, any Non-personal Information connected or linked to any Personal Information shall be deemed as Personal Information as long as such connection or linkage exists.

We do not collect any Personal Information from you or related to you without your approval.

3. How Do We Collect Information on Our Users?

  1. We collect information which you provide us voluntarily. For example, we collect Personal Information which you voluntarily provide when you contact us directly – as seen above
  2. We collect information through your use of the Services. When you are using the Services approved by you following your registration to Deemly, you allow us to gather, collect and record the information relating to such usage, either independently or through the help of third-party services as detailed above.

We store the Personal Information either independently or through the help of our authorized third-party service providers as detailed below.

We do not scrape the internet for your information.

4. What are the Purposes of the Collection of Information?

We collect Non-personal and Personal Information in order to provide and operate Deemly and the Sites, including for statistical and research purposes; to enable us to further develop, customize and improve the Services based on Users common preferences and uses; and to enable us to provide our Users with a better user experience and with technical assistance and support.

By signing up to Deemly, you automatically permit Deemly to send newsletters that are exclusively related to your Deemly profile as well as the product - these can always be turned off.

5. Sharing Information with Third Parties

We will not share any Personal Information it collects with any third party except with your explicit consent.

You hereby acknowledge and agree that for the purposes of providing the Services, our analysis of your Personal Information as it is reflected in the Deemly Trust Profile will be public and thus provided to any other Users of the Services and to an Approved Third Party.

You further acknowledge and agree for the purpose of providing the services we shall provide personal information about you in connection with your existing accounts on third party services and/or your activities therein, to third party business partners of Deemly, which offer marketplace or sharing economy services.

Notwithstanding the foregoing, the Company may disclose Personal Information in the following cases:

  • to satisfy any applicable law, regulation, legal process, subpoena or governmental request
  • to enforce this Privacy Policy, including investigation of potential violations thereof
  • to detect, prevent, or otherwise address fraud, security or technical issues
  • to respond to Users' support requests
  • to respond to claims that any content available on the Services violates the rights of third-parties
  • to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment
  • to protect the rights, property, or personal safety of the Company, its Users, or the general public
  • when the Company or any of its affiliates is undergoing any change in control, including by means of merger, acquisition or purchase of all or substantially all of its assets
  • to collect, hold and/or manage your Personal Information through the Company's authorized third party service providers (for example, the Amazon Web Services Platform), as reasonable for business purposes, which may be located in a country that does not have the same data protection laws as your jurisdiction
  • pursuant to your explicit approval prior to the disclosure
  • to cooperate with Third Party Services and other third parties as required for providing you with the Services and enhancing your user experience

For avoidance of doubt, the Company may transfer and disclose to third parties or otherwise use Non-personal Information at its sole discretion.

6. Deletion and rectification of Personal Information

If for any reason you wish us to delete your Personal Information which is stored with us and identifies you, please send us an e-mail to: info@deemly.co and we will make reasonable efforts to delete all Personal Information pursuant to any applicable privacy laws within 5 working days.

If you wish to change any data points that are not editable through the "Edit Profile" on your Deemly profile we will make reasonable efforts to update Personal Information pursuant to any applicable privacy laws within 5 working days.

Most data on your Trust Profile is gathered from your connected profiles' but if you see any information that does not reflect your current information please let us know and we will update accordingly.

Note that unless you instruct us otherwise we may retain your Personal Information for a period of 36 months or a longer period as reasonably required in order to provide the Services and as legally permissible or required.

7. Minors

To use the Services, you must be over the age of eighteen (18). The Company does not knowingly collect Personal Information from children under the age of eighteen (18) and does not wish to do so. We reserve the right to request proof of age at any stage so that we can verify that minors under the age of eighteen (18) are not using the Services. In the event that it comes to our knowledge that a person under the age of eighteen (18) is using the Services, we will prohibit and block such User from accessing the Services and will make all efforts to promptly delete any Personal Information stored with us with regard to such User.

8. Security

We take great care in implementing and maintaining the security of the Services, and the User's Personal Information. The Personal Information is hosted on the Microsoft Azure Platform which provides advanced security features. The Company employs industry standard procedures and policies to ensure the safety of its Users’ Personal Information, and prevent unauthorized use of any such information. However, we do not and cannot guarantee that unauthorized access will never occur.

9. Third Party Service Providers

While using the Services we may be using third party software and/or services, in order to collect and/or process the information detailed herein. Such software includes without limitation, Google Analytics, which privacy policy is available at Google and the Microsoft Azure Platform, which security policy can be found at: Azure Trust Center.

Both listed under the Privacy Shield.

10. Third Party Sites and Services

While using the Services you may encounter links to third party websites, content and/or services, including to Third Party Services. Please be advised that such services are independent from the Company, and if you click on any of these links, these services may use cookies and other web-tracking technologies to collect non-personal and/or personal information about you.

We assume no responsibility or liability whatsoever with regard to privacy matters or any other legal matter with respect to such services. We encourage you to carefully read the privacy policies and the terms of use or service of such services, as their terms, not ours, will apply to any of your interactions with such services.

11. Cookies

When you access or use the Services, the Company may use industry-wide technologies such as "cookies" (or similar technologies), which store certain information on your computer ("Local Storage") and which will allow us to enable automatic activation of certain features, and make your service experience much more convenient and effortless.

The cookies used by the Services are created per session, do not include any information about you other than your session key, and are removed as your session ends.

It is easy to prohibit Local Storage. Most browsers will allow you to erase cookies from your computer's hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. However, if you block or erase cookies your online experience may be limited.

We do not track you across the web

12. Direct Marketing

You hereby agree that we may use your contact details for the purpose of informing you regarding our products and services which may interest you, and to send to you other marketing materials, transmitted to the main email address you have provided.

You can always change this under the "Edit Profile"-page on your Deemly account.

13. Changes to the Privacy Policy

The Company reserves the right to change this Privacy Policy at any time and at its sole discretion, so please re-visit this page frequently. We will provide notice of substantial changes of this Privacy Policy on the homepage of the Site and/or we will notify you via email regarding such changes. Such substantial changes will take effect seven (7) days after such notice was provided on any of the above mentioned methods. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last Revised” date and your continued use of the Services after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes.
